FLIP CANDY(“MOBISIX” or “FLIP CANDY” or "SPONSOR").
TO ENTER: There are three ways to enter for a chance to win. i) Text mall-specific
keyword as prompted through on-site, in-mall, or at-center signage to join FLIP
CANDY;
ii) Log onto http://www.flipcandy.com/ (the “Website”) to join FLIP CANDY and register
accordingly indicating a property as “preferred mall” and providing the required
information; or
iii) Mail an 8 x 11.5 inch letter addressed to Sweepstakes Admin, attn: FLIP CANDY
Sweepstakes, 2101 Rexford Rd, Ste
300W, Charlotte, NC 28211 and include your name, age, preferred mall, phone number,
address, city, state and zip code.
Entries must be received or postmarked between Thursday, April 1, 2010 and Friday,
December 31, 2010. Mail-in entries must be received no later than 3 days after the
postmark date. Limit one entry per person, regardless of method of entry. All entries
become the Sponsor’s property and will not be returned.
By registering for FLIP CANDY, you agree to allow either MOBISIX, or their representatives
and agents (“Sponsor and its Administrators”), to access the mobile number and information
provided on the registration form, for purposes of sending you marketing promotions.
Message and data rates may apply. Joining or participating in FLIP CANDY does
not increase your chances of winning the Sweepstakes. You may opt-out of FLIP CANDY
at any time. To do so, send an email to flipcare@flipcandy.com entering
UNSUBSCRIBE FROM FLIP CANDY in the subject line and your registered mobile phone
number in the body of the email. When the Sponsor receives this notice, your name
will be removed from the mailing list for FLIP CANDY, but you will still be eligible
to win the prize.
Registering for the FLIP CANDY sponsored Sweepstakes by mail allows you to participate
in the Sweepstakes only; you will not be enrolled in FLIP CANDY.
ELIGIBILITY: Open to legal residents of the fifty (50) United States who are 13
years of age or older at the time of entry. Any entries for individuals younger
than 13 years of age will be deleted or destroyed. FLIP CANDY, and its parent companies,
affiliates, subsidiaries, partners, advertising and promotional agencies and each
of their respective officers, directors, employees, and agents ("Sponsor and its
agents") and members of their immediate families and people living in the same household
of each are not eligible.
WINNER SELECTION: Winner will be selected in a random drawing on or about Tuesday,
January 4, 2011. Odds of winning depend upon the number of eligible entries received.
Each person may enter only once, but there is no limit on the number of people who
may enter.
GRAND PRIZE: One Grand Prize winner will receive: $1,000.00 in Mall Gift Cards.
Approximate Retail Value (“ARV”): $1,000.00. All gift cards are subject to the terms
and conditions of the gift card issuer, including service fees.
CLAIMING PRIZE: The winner will be notified by email or phone and will be required
to respond within twenty (20) days of notification or the prize will be forfeited
and an alternate winner will be selected. This unverified winner will be required
to sign and return a notarized Affidavit of Eligibility & Liability and Publicity
Release (“Affidavit & Release”) which must be received by Sponsor within 14 days
of the date of receipt of such documents or the prize will be forfeited and an alternate
winner selected. If the unverified winner is under the age of 18, the minor’s parent
or guardian must also sign the Affidavit & Release.
ADDITIONAL TERMS: By entering, you agree to: (1) be contacted by the Sponsor, or
a designated administrator, via email, mail, or phone; (2) be bound by the Official
Rules and the decisions of the judge whose decisions are final; and (3) release
the Sponsor and its agents from all liability for injuries, loss and/or damage of
any kind arising from your participation in the Sweepstakes and the acceptance and
use/misuse of any prize. Additionally, you agree that FLIP CANDY and each of its
parent companies, partners, affiliates, subsidiaries, directors, officers, agents,
vendors and employees (collectively “Released Parties”) shall not be liable for
damages, losses or injuries resulting from participation in this Sweepstakes, promotion,
or usage of the prizes. In the event of a dispute regarding the identity of a winner,
the winner will be the party who established the email account or the mobile phone
account. No prize substitutions allowed except by Sponsor, who reserves the right
to substitute a prize of equal or greater value if advertised prize becomes unavailable.
Prizes are not transferable or redeemable for cash. This Sweepstakes is governed
by the laws of North Carolina. Mass entries, or entries generated by a script, macro
or use of automated devices will be disqualified. Entries become the property of
the Sponsor, who is not responsible for lost, late, illegible, incomplete or misdirected
entries. The Released Parties assume no responsibility for: any incorrect or inaccurate
entry information; human error; technical malfunctions; failure, omission, interruption,
deletion, or defect of any telephone network, computer online systems, computer
equipment, server provider, or software, including any injury or damage to participant's
or any other person's computer relating to or resulting from participation in this
Sweepstakes; inability to access the Website; theft, tampering, destruction, or
unauthorized access to or alteration of entries; transactions that are processed
late or incorrectly or are incomplete or lost due to computer or electronic malfunction
or traffic congestion on the Internet or at any website; printing or human errors;
and any mailed entries which are late, lost, incomplete, misdirected, stolen, mutilated,
illegible or postage due (except for postage due for VT residents), or any combination
thereof. Proof of mailing is not considered proof of delivery or receipt. Winners
and unverified winners agree that: (i) by accepting a prize, each winner consents
to the use of his/her name and likeness for advertising and promotional purposes
without additional compensation in all media (except if winner is a resident of
TN or where otherwise prohibited by law); (ii) winner is responsible to comply with
all laws and to pay all federal, state and local taxes applicable to the acceptance
and use of the prize. If the prize is valued at $600.00 or higher a 1099 tax form
will be issued in the winner’s name for the ARV. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY
DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION
OF CRIMINAL AND CIVIL LAWS. SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES
FOR ANY SUCH VIOLATIONS FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY
LAW, INCLUDING CRIMINAL PROSECUTION.
WINNER’S LIST: For a list of winners, send a stamped, self-addressed envelope postmarked
by Monday, January 3, 2011 to: Sweepstakes Admin, attn: FLIP CANDY Sweepstakes,
